Evaluation of implementation of the Section 6 Biodiversity duty

The Welsh Government has commissioned OB3 Research to undertake an evaluation of the Section 6 Biodiversity Duty. The aim of the evaluation is to

  • establish the extent to which the section 6 duty has been implemented/complied with in the first three years, through the production of plans and reports, and/or through mainstreaming action across organisations

  • investigate the enablers and barriers to its implementation

  • establish to what extent the guidance provided has been useful, has been followed, and what further guidance and/or support could be provided.

As part of this evaluation OB3 Research will be gathering information through a survey and semi-structured interviews with individuals. The Welsh Government is the data controller for the research. The Welsh Government will receive a copy of the data collected by OB3. However, OB3 Research will delete any personal data provided through interviews and anonymise the raw data before it is shared with the Welsh Government. 

The information collected over the course of the evaluation will be included in a report published on the Welsh Government website and possibly in other publications by OB3 Research and Welsh Government.

Your participation in this research is completely voluntary. However, your views and experiences are important in order to help inform Welsh Government policies.

Why we collect and process the data collected

In order to further facilitate the implementation of the section 6 duty and related policy, it is necessary for Welsh Government (we, us) to collect and hold personal information about you in order to fulfil our public task and exercise our official authority.

Welsh Government will be the data controller for your personal information.

What will we use your information for

It is necessary to process your personal information in order to:

  • Maintain a section 6 duty public authority contact list

  • Send and share information including relating to meetings, engagement events and consultation exercises, e.g. meeting agendas, supporting documents for meetings and events, and research and consultation papers

  • To assist us in developing current and future policy and guidance in relation to the section 6 duty

  • Arrange meetings and hospitality appropriately

  • Capture your comments and feedback

What information is being collected?

  • your name

  • your work email address

  • your employer/organisation you represent

  • your mobile or work phone number

Who will we share your information with?

We will share your name, work email address and details of your employer or the organisation you represent with other bodies subject to the section 6 duty, in the context of arranging meetings and events and sharing information to support the operation when required.

We may also share your name, work email address and details of your employer or the organisation you represent with third parties working under contract on behalf of the Welsh Government supporting the biodiversity duty work area.

All data is stored securely on Welsh Government systems. 

How long will we retain your information?

We will review the list at regular intervals

Accuracy of your information

It is important that we hold accurate and up to date information about you in order to deliver the appropriate services. If any of your details have changed, please ensure that you inform us as soon as possible so that we can update our records.

Your rights

You have the following rights in relation to the personal information we hold. You have the right to:

  • access a copy of your own data;

  • require us to rectify inaccuracies in that data;

  • to object to or restrict processing (in certain circumstances);

  • have your data ‘erased’ (in certain circumstances); and
